GOAL: The primary purpose of sentencing is to punish the offender. Rehabilitation is a desired goal of the criminal justice system but is subordinate to the goal of punishment. F.S. 921.001(4)(a)2.
FACT: The scoring of an offender on a guidelines scoresheet for purposes of sentencing is based solely on the primary and additional offenses, circumstances surrounding the primary and additional offenses (such as the extent of victim injury), the offender's prior criminal history, and other legal factors pertaining to the offender's criminal behavior. Information on the needs of the offender may be taken into consideration at the time of sentencing, but are not a part of the offender's score and are not the primary focus of the court's attention. This goal is more subjective in nature, and therefore, cannot be measured by the data collected in the guidelines database.
